Hundreds of Palestinians in Gaza have been massacred and wounded today as Israel has launched a massive bombing campaign against the people of Gaza. The bombing rampage took place as thousands of Palestinian children were in the streets on their way home from school. Palestinian parents were running frantically in the streets looking for their children as U.S.-provided F-16s and Apache helicopters rained down more than 100 bombs and missiles on Gaza.

The U.S.-backed Israeli Occupation Force destroyed every security station in Gaza. AFP reported: "There was no space left in the morgue and bodies were piled up in the emergency room and in the corridors, as many of the wounded screamed in pain."

Because of the U.S.-backed Israeli blockade and strangulation of the people of Gaza for the past 18 months there is little or no medicine to treat the wounded, electricity for hospitals, or food or clean water for much of the population.

An Israeli military spokesperson said, "The operation is 'only just beginning'." The Israeli Defense Ministry said in a statement: "The action will continue and will widen as much as is demanded according to the evaluation of the situation by the high command of the army."

Gunness, a spokesman for the U.N. Relief and Works Agency for Palestinian Refugees (UNRWA), said the agency has been unable to get needed medical supplies into Gaza for more than a year, because of Israel's blockade of border crossings.

Thanks for the email and the book. I have some concerns, which I have pasted below. I have also updated the new version of the contract.


Here they are:


1.

Thanks for the free book, it just arrived today. There are many concerns I have. Most could have been resolved if I was contacted before hand.

2.

I have explained my situation to a variety of people. Most people are telling me I need to find a lawyer. I do not want to do this. However, there is a good point that I feel needs to be made - this should not have happened, and I cannot passively just let this be. For compensation I have some amendments to the contract.

3.

One thing I am very peeved about is that I was not able to look at what you were planning to include in the book before it was printed to check for errors that you may have made. I already found one. There is no such person as a "Rheal Lewitski." However, I do know a "Rhea Lewitski." Rhea will be saddened to see her name like this in such a widely available book, especially since she just started teaching creative writing and her students will undoubtedly see this book.

Another concern is that if I was informed beforehand I would have asked permission to use everyone's names that were used. I am sure it is completely fine with them. You might not even need legal permission to print someone's name, I don't know? However, to be courteous, I would have asked everyone.

Also, nowhere is it stated that these are art-works. What if a current collector of mine sees this and then becomes to believe that the work that he or she owns is not actually art? That it is pure gimmick?

I will get to these later.

4.

Regarding the contract you sent:

I had a literary agent look over the contract. He told me to strike paragraph four because it is pointless at this point. Also in that section of the contract that you emailed me it states that xxxxxxxxx is the sole author of the work. She is not, I am. It should say "David Horvitz." I contacted xxxxxx and she didn't know why her name was there.

In regards to paragraph 6, it states that the copyright information will appear on the "copyright page of every copy of the Work printed." How can this be since the books are already printed. Maybe it will be the case for future printings (if you do do future printings), but I find it quite impossible to have that printed on "every copy of the Work..." Strike that as well.

5.

Now to amend my three concerns before.

I would like a sincere letter of apology be mailed to Rhea Lewtiski. I can provide you her mailing address. I will add this into the contract.

I would also like the publisher to mail letters to the 70 people that were listed explaining to them that their names are featured in the book. I will add this to the contract.

I would also like an official document written to me explaining that you had made a mistake in not recognizing these as art-works. I will show this document to people in the future who see the book and have concerns over my practice as a legitimate art-practice. This is extremely important for my future career as an artist. This is to be signed and notarized. I will ad this to the contract.

6.

The following are further amendments to the contract. Please take me seriously here, this is not a joke.

Miya Osaki is a friend of mine. She has always supported me. I would like to show my appreciation of our friendship and her support of my art-practise with a dinner at Sushi Gari on 78th Street in New York with her husband, xxxx xxxx. The cost of this dinner will be covered by the publisher.

I would like to have a nice walk in Central Park or Prospect Park in New York with you (xxxxxxxx). This will be done the next time you are in New York. I recommend the fall or spring. This will not cost anything except your time. You can refuse this, I won't be offended.

I would like the publisher to pay for a nice dinner between two janitors who maintain the cleanliness of the publisher's offices, and two employees of the publisher. The publisher must provide me photographic documentation of this dinner, as well as a list of the 4 participants.

My friend Vlatka Horvat had purchased a copy of the book at LAX airport. She notified me that my section had an ink smear on it. I would like the publisher to send her a new copy of the book. She can mail the publisher her copy if the publisher would like.

I would like the publisher to make one purchase from my website: www.davidhorvitz.com/if. The publisher can purchase anything. Prices range from $1 to thousands of dollars.

For the month of January I will be residing in Berlin while I finish writing a children's/young adult book. After I am finished, employees of the publisher who specialize in reviewing books submitted for publishing will look at my manuscript with extreme special attention. They will then write a critical response to the book. I do not expect that they will agree to publish the book, but I do expect a critical response as to why they wish to or wish not to publish the book.

To help me write the book while I am in Germany the publisher will send me Japanese Gyokuro tea. The publisher can purchase it from where they wish. However, I recommend www.hibiki-an.com.

I would also like the publisher to pay me an extra $114.80, besides the $500, to cover the damages done.

And finally, I would like the publisher to make a donation to the Barack Obama presidency. The publisher can donate however much they wish. It can be done easily online at this web-site: www.barackobama.com.

UP AGAINST THE WALL.

I was published in the Dave Eggers edited book, The Best American Non Required READING, published by Houghton Mifflin.

I was not told.

I was flattered that they wanted me, but I saddened that they did not tell me and because of this, among many other things, i was not able to preview it, and they printed my friend's name spelled WRONG.

They want me to sign a contract and accept a small amount of money.

I do not want to sue (everyone says i should) b/c that is not fun. However, I have some amendments to the contract.

AGREEMENT made as of 5 December 2008 between David Horvitz (hereinafter referred to as the “Rights Holder”s), and Houghton Mifflin Harcourt Publishing Company, 222 Berkeley Street, Boston, MA 02116 (hereinafter referred to as the “Publisher”) concerning publication of a piece entitled

as part of a collection entitled THE BEST AMERICAN NONREQUIRED READING 2008 (hereinafter referred to as the “Work”) on the following terms:


1. GRANT OF RIGHTS The Rights Holder grants permission to the Publisher to reprint the Selection in the Work in the English language only.


The rights herein granted to the Selection are non-exclusive and include: (a) the right to publish the Selection as part of the Work in print form, and to sell and distribute copies in the United States, its dependencies, the Philippines and Canada, and throughout the world, with the exception of the British Commonwealth (as defined as of the initial publication date of the Work); (b) the right to license book club rights; and (c) the right to grant gratis permission for publication or transcription into Braille and other aids for the handicapped. For the purposes of this paragraph, “publication” shall refer to the publication of the Selection as part of the Work. The Rights Holders retain exclusive rights to the Selection when published apart from the Work in all formats. The Publisher will reprint the Selection with no changes, except for any copyediting necessary for accuracy and consistency throughout the Work subject to the author’s approval.


2. PAYMENT Upon publication of the Work by the Publisher this Rights Holder shall receive an outright payment of $500.


3. TERMINATION If the Work is out of print in all editions, and if the Publisher does not, after receipt of written notice by the Rights Holders, issue a new edition within six (6) months after receipt of such written notice, unless prevented by strikes, paper shortage or other circumstances beyond their control, then this Agreement shall terminate and all rights herein granted shall revert to the Rights Holders.




4. RIGHTS HOLDER WARRANTIES The Rights Holder warrants to the publisher that M. C. is the sole author of the Selection; that the Selection is original; that the Selection has not been previously published within a collection in book or electronic form except as otherwise disclosed to the Publisher; that the Selection is not in the public domain, and does not infringe upon any statutory copyright or upon any common law right, proprietary right, or any other right of third parties; that the Selection contains no matter which is libelous, in violation of any right of privacy, or otherwise contrary to law; that the Rights Holder are the exclusive owners of the rights herein conveyed to the Publisher; and that the Rights Holder has full power to enter into this Agreement and to make the grants herein contained. The Rights Holder is not aware of any expression of concern, claim or demand made by a third party which is inconsistent with the above warranties, and will promptly notify the Publisher in writing if any such claim is made or threatened in the future. These warranties shall survive the termination of this Agreement.



5. FREE COPY One (1) free cloth copy of the Work shall be sent to the Rights Holder upon publication.



6. ACKNOWLEDGMENT The following acknowledgment will appear on the copyright page of every copy of the Work printed:

12. NEW BOOK FOR VLATKA HORVAT The publisher will send Vlatka Horvat one (1) free copy of the Work.

13. PURCHASE OF ART-WORK The Publisher will purchase one art-work of the Rights Holder on the Right's Holder's website: www.davidhorvitz.com/if

14. SPECIAL REVIEW OF MANUSCRIPT The Publisher will specially review a future manuscript of the Rights Holder. The Publisher will send the Rights Holder detailed reasoning for their choice to publish or not publish the manuscript.
